1. Acceptance of Terms

By downloading, installing, registering on, or using the SulahMitra mobile app or website, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to all terms, you must refrain from using our services.

2. Scope of ODR Services

SulahMitra acts as a neutral Online Dispute Resolution (ODR) facilitator providing technological infrastructure, case management, and access to trained independent mediators and arbitrators. SulahMitra is an independent dispute resolution platform and does not operate as a law firm or court of law.

3. Legal Validity & Enforceability

Settlement agreements executed through SulahMitra conciliation proceedings carry legal validity pursuant to Section 74 of the Indian Arbitration and Conciliation Act, 1996, holding the same force and effect as a decree passed by a Civil Court of India. Arbitral awards rendered through digital arbitration sessions are legally binding under Part I of the Act.

4. User Responsibilities & Conduct

When utilizing the platform or mobile application, users agree to:

• Provide accurate, honest, and verifiable information regarding claims, identity, and uploaded evidence.
• Engage respectfully during virtual mediation sessions without abusive, illegal, or defamatory conduct.
• Maintain absolute confidentiality regarding proposals, admissions, and proceedings exchanged during mediation.
• Refrain from attempting unauthorized access, reverse-engineering, or tampering with the platform's codebase or mobile application.

5. Confidentiality Mandate

Pursuant to Section 75 of the Arbitration & Conciliation Act, 1996, all conciliation proceedings, virtual hearings, submitted documents, and negotiations are strictly confidential and inadmissible in subsequent court litigation unless required by law.

6. Limitation of Liability

SulahMitra provides digital ODR infrastructure to facilitate mutual resolutions. While neutral mediators guide parties toward consensus, SulahMitra does not guarantee a specific outcome for any dispute and shall not be held liable for indirect, incidental, or consequential damages resulting from user actions or missed session deadlines.

7. Account Security & Termination

Users are responsible for safeguarding their login credentials and OTP verifications. We reserve the right to suspend or terminate user access in the event of fraudulent activity, breach of confidentiality, or violation of these Terms.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of the interpretation of these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
